Answer:

Judge Satchwell, in ITC Case number: 0038/2015, said the following (in a similar situation): 

“I am sympathetic to any taxpayer who is confronted with an enormous amount of tax to be paid in terms of an assessment where it was the ignorance of the taxpayer which led to his or her failure to comply with the provisions of the TAA.”

You said, in the first request, that this in dispute.  We accepted that an objection has been lodged and that you are now lodging an appeal.  We did deal with that in our first response. The documents that the taxpayer have, and that includes the bank statements, if they were not given to SARS earlier, must then accompany the notice of appeal.  

We asked about the grounds of the objection, but if this was not a ground, you will add it as a ground of the appeal.  Namely, the taxpayer didn’t keep all the required documents and only have the bank statement. As we said in the first response, the court will then decide the issue.  You can elect to have the matter dealt with under the alternative dispute resolution process or take it to the tax board (depending on the amount of tax involved).
