Cross-border considerations for advisers

Overview

Advising clients on the key considerations of wealth and succession planning by global expansion or relocation without being aware of the South African consequences and that of the anticipated end-jurisdiction(s) could create an undesirable tax, legal, family and business succession web and an array of disputes. This could lead to a merely impossible task of untangling the advice, resulting in additional costs and reputational risks for clients and advisers. This event, consisting of two parts, will use case studies to review the impact of unknown traps and real-life scenario planning that advisers must be aware of. The event will actively deal with the influence of certain life and family triggers on the wealth of a family/business, by death and/or divorce, and look at different jurisdictional planning scenarios.

Day 1: Thursday, 20 August (09:00 - 12:00)

The first session will cover the following aspects:

  • Considerations for wealth and business structures from a South African perspective, considering global expansion and/or relocation
  • United Kingdom: Pre-arrival planning, reporting and tax
  • United States of America: Pre-arrival planning, reporting and tax

Day 2: Friday, 21 August (09:00 - 13:00)

The second session will cover the following aspects:

  • International trust landscape: Practical governance for family trusts
  • Trusts and related structures: Global transparency
  • Family offices in Africa and commentary on the different kinds of family offices
  • Where to ideally set up a family office: Transparency of rationale/suitability for the location (a global perspective)
  • Wealth taxes in South Africa
  • Wealth preservation in trusts across borders and generations, with a specific focus on the global and local threats of divorce actions against trust assets
